Cheating on a drug test in Texas, is that a crime?
So you have found yourself needing to pass a drug test, but you aren’t quite sure how that will turn out. What to do? A lot of you are working to beat the piss test, and that’s not the focus on this post. This is about what happens if you get caught trying to fake test results.
What’s the law in Texas on cheating a drug test?

Texas Health and Safety Code § 481.133. Offense: Falsification of Drug Test Results
(a) A person commits an offense if the person knowingly or intentionally uses or possesses with intent to use any substance or device designed to falsify drug test results.
(b) A person commits an offense if the person knowingly or intentionally delivers, possesses with intent to deliver, or manufactures with intent to deliver a substance or device designed to falsify drug test results.
(c) In this section, “drug test” means a lawfully administered test designed to detect the presence of a controlled substance or marihuana.
(d) An offense under Subsection (a) is a Class B misdemeanor.
(e) An offense under Subsection (b) is a Class A misdemeanor.
Now in the real world I’ve seen very few of these cases. It’s mostly people on probation who get caught with fake pee etc. So if you are faking drug test for work, I guess they could charge you, but I’ve never seen that happen. Still, it’s a misdemeanor offense if you are caught, so don’t get caught!
